Terms of Service

1. Acceptance

By using GeniPhoto AI, you agree to these Terms. On mobile, you also agree to the standard End User License Agreement (EULA) of your platform (Apple or Google).

2. Account Access

You authenticate via email or phone OTP. You are responsible for maintaining access to your authentication method. We do not manage passwords or user profiles.

3. AI-Generated Content

3.1 Nature of Output

AI results are algorithmically generated and provided "as is." Results may be inaccurate, distorted, or unexpected. We make no warranties about fitness for any purpose.

3.2 Ownership

You retain ownership of photos you upload. You own the AI-generated outputs, subject to the restrictions below. By uploading, you grant InnovatedY a limited, temporary license to process and transmit your images solely to deliver the AI result.

4. Prohibited Use — Content Safety Policy

You MUST NOT use GeniPhoto AI to:

• a) Generate, distribute, or store Child Sexual Abuse Material (CSAM) in any form. Any suspected CSAM will be reported to relevant law enforcement authorities.
• b) Create non-consensual intimate imagery (NCII) or "deepfakes" of real individuals — including sexual, violent, or defamatory depictions created without the subject's consent.
• c) Generate imagery depicting real individuals in false, misleading, or harmful contexts without their consent.
• d) Produce content that is illegal, promotes violence, constitutes hate speech, or targets protected groups.
• e) Infringe upon the intellectual property or privacy rights of any third party.
• f) Upload images of minors without the explicit consent of their legal guardian.

Enforcement: Violations result in immediate account termination and reporting to relevant authorities. We cooperate fully with law enforcement investigations.

5. Content Reporting

To report content that violates these Terms, contact: support@innovatedy.com. We will investigate and respond within 1 business day.

6. Payments & Subscriptions

Premium features may be available via in-app purchases processed through the Apple App Store or Google Play Store. Subscriptions are managed and cancelled through your app store account settings. Refund policies are governed by the respective app store terms.

7. Limitation of Liability

To the maximum extent permitted by law, InnovatedY shall not be liable for:

• Indirect, incidental, or consequential damages from use of the app or AI-generated content.
• Any harm resulting from reliance on AI-generated output.
• Service interruptions caused by third-party provider outages.

8. Indemnification

You agree to indemnify InnovatedY against claims arising from your misuse of AI-generated content, including violations of Section 4.

9. Termination

We may suspend or terminate your access for violations of these Terms. You may delete your account at any time via Settings > Delete Account.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
